
Question 1. My insurance company
is denying me benefits. What can I do?
You need to contact an attorney and provide
them with a copy of your insurance policy to see if the
insurance company denied you benefits due to an existing
exclusion in the policy. If the benefits are not excluded
then you may be able to file a lawsuit against the
insurance company.
Question 2. My insurance coverage
has been cancelled. What can I do?
If the insurance was cancelled for a valid
reason, such as nonpayment of premiums and material
misrepresentation, you probably have no legal recourse
against the insurance company. If the insurance company
cancelled your policy for no apparent reason, you may be
able to file a complaint with the Department of Insurance,
and you should contact an attorney immediately.
Question 3. My HMO refuses to
authorize medical treatment that is medically necessary.
What can I do?
There is an appeals procedure you must follow
pursuant to your HMO policy. If the insurance company
denies your request for an appeal you may have legal
recourse against the company.
